INITIAL PRIVACY NOTICE/DISCLOSURE AND OPT OUT AGREEMENT


IMPORTANT INFORMATION REGARDING YOUR PRIVACY AND OUR PRIVACY POLICIES AND PROCEDURES GIVEN; PURSUANT TO GRAMM-LEACH BLILEY ACT, ALSO KNOWN AS FINANCIAL SERVICES MODERNIZATION ACT AND REGULATIONS OF THE FEDERAL TRADE COMMISSION (FTC) SET FORTH IN 16CFR PART 313


PRIVACY NOTICE:  Under the "Privacy Rule", and for the purpose of this disclosure, and as described by the "GLB ACT" (Gramm-Leach-Bliley Act), which we found on the "FTC's" (Federal Trade Commission's) web site; Promise Lenders is a "financial institution" because we are "significantly engaged" in "financial activities" as described in the "GLB ACT" on the web site listed above and in section 4(k) of the Bank Holding Company Act, as we are a "mortgage broker" engaged in the act of "brokering loans".  To this end, Promise Lenders needs to collect personal information about you.  We understand how important it is to protect your privacy and your "non-public personal information" (NPI), with respect to your personal financial information.  We will gather and distribute information only as our understanding of the laws allows.  We will use this information only when we deem it necessary in furtherance of your stated mortgage needs and requests, both verbally and/or written.  We will protect and maintain your privacy and "NPI" as best we are able and as is our understanding of that which is required by law.  We will provide you with the means to "opt out".  We will provide you with our last known WWW. Web site address that we relied upon to create this disclosure and to protect your "privacy", which is likely still available for you to reference or verify the information and statements contained herein.

  1. SOURCE(S) FROM WHERE PRIVACY LAWS, RULES AND REGULATIONS ARE DERIVED:  The Gramm-Leach-Bliley Act required the Federal Trade Commission (FTC) and other government's agencies that regulate financial institutions to implement regulations to carry out the Act's financial privacy provisions (GLB Act).  This act seeks to protect consumer financial privacy.  Its provisions limit when a "financial Institution" may disclose a consumer's "nonpublic personal information" to nonaffiliated third parties.  The Privacy Rule, along with this Guide and other GLB Act materials, are available online at the FTC's homepage, www.ftc.gov, under the heading "Gramm-Leach-Bliley Act Financial Privacy and Pretexting".  Furthermore, you should contact an attorney who practices this area of law should you have further need for information.  Lastly, be advised that Promise Lenders is not an attorney and cannot represent or advise you, as a matter of law in this area.

CATEGORIES OF PERSONAL INFORMATION:                       APersonal Information can be public if obtainable through public available means.  This information, depending on how it was collected, may be used and shared with "affiliated" and/or "non-affiliated" third parties, and may be used in furtherance of your mortgage needs. B)           "Non-Public Personal Information" or "NPI" refers to information about you that we receive from sources described below in section 3; and that is not otherwise lawfully available to the general public.  For more information including exceptions to what may be considered "NPI"; please see: "ABOUT THE GLB ACT"; sections, I, II and III; by visiting the web site listed above.  Promise Lenders had used the information contained on the FTC's web site and makes no guarantees that said information will still be available or in the same place on the FTC's web site and makes no guarantees that said information will still be available or in the same place on the FTC's web site, although we have no reason to believe there will be any changes to said web site.


SOURCES FROM WHERE WE WILL LIKELY GATHER PUBLIC AND NON-PUBLIC PERSONAL INFORMATION "NPI" AND WHAT WE MAY DO WITH YOU NON-PUBLIC PERSONAL INFORMATION:  The personal information we collect about you the consumer(s) or about you or customer(s) are the combined information(s), including but not limited to name, social security number, address and date of birth; that we receive from: you, your loan application or other forms, transactions with us, our affiliates or others, the documents or copies thereof that you provide to us, consumer-reporting agencies and credit bureau report(s), your bank(s) or investment broker(s) or statements, your employer(s), your mortgage company(s) or landlord(s) both past and present, court or other public records and information, your creditors, other person with whom consumers and/or customers do business.  In turn, we would likely share this information, in part or in whole, with one or more of the following:  banks, and lenders, other brokers, appraisers, attorneys and title companies, credit reporting agencies, various other professionals involved in the application and approval process, non-affiliated third parties such as publishers, retailers, direct marketers, financial service providers, airlines and publishers, and non-affiliated third parties as well as affiliated third parties.  We may also disclose "NPI" to companies that perform marketing services on our behalf or to other financial institutions with which we have joint marketing agreements.


 



  1. PROMISE LENDERS RECOGNIZES YOUR EXPECTATION OF PRIVACY POLICIES AND PRACTICES TO PROTECT YOUR PERSONAL INFORMATION.  We protect the personal information we collect from you by maintaining physical, electronic, and procedural safeguards in accordance to the applicable law.  Our staff is trained to property handle personal information.  We collect only the information that we feel is or may be needed to properly service you as a consumer and/or you as our customer.  We do not disclose nonpublic personal information about our customers to nonaffiliated third parties, except as permitted by law.  We may disclose all of the information we collect, as described above, to companies that perform marketing services of our behalf, or to other financial institutions with whom we have marketing agreements.  We recognize that you expect privacy and security as it relates to our dealings with your personal and financial affairs.  We understand the need to safeguard our sensitive information about you with which you have entrusted us.  Therefore, we maintain standards and procedures designed to prevent misuse of this information and we encourage you to inquire more as to how we treat this information.


 



  1. YOUR RIGHT TO "OPT OUT" FROM ANY DISCLOSURE OF INFORMATION.  If you do not wish Promise Lenders to furnish your Non-Public Personal Information "NPI" to service providers, affiliates or non-affiliates then do not sign this form.  By signing below, Promise Lenders will proceed on the direction that you wish for us to share your "NPI" with those whom the law allows.  If over time you change your mind and wish us to discontinue our sharing of our "NPI" of yours, you must call in such a request to our main office at (508) 429-7888 and then follow-up in writing to our main address at: 13 Water Street, Holliston MA 01746.  You may also call or write us for further information or to confirm we have received and such request.  By doing so you are "opting out" which in turn limits our ability to provide you with further mortgage services and may make it impossible for us to continue with any mortgage financing transaction(s) we would then be conducting on your behalf.  If this is a joint notice, to more than one applicant you must share it with the applicant.  Other privacy notice by us or requests by you may be executed by an applicant and will count as if all applicants have executed it.

  1. US Patriot Act


To help the government fight the funding of terrorism and money laundering activities, Federal law requires all financial institutions to obtain and verify and record information that identifies each person applying for mortgage financing or opening an account.  We will ask for your name, address, date of birth, social security number and other information that will allow us to identify you.  We may ask for two forms of government identification.  We may ask for two forms of picture identification.  Please be as helpful as possible in this matter.



  1. APPRAISAL REPORT


In considering your application, PromiseLenders will obtain an appraisal of your property.  When it is complete this appraisal report will be available at our office for your review.  We will give you a copy of the appraisal report if you ask us for one, at no additional charge to you.



  1. LEGAL REPRESENTATION


The law requires us to give you the following information:


You may have legal interests that differ from ours.  We will use an attorney to close this mortgage loan.  We may not require you to be represented by the attorney who represents us.  You have the right to hire your own attorney to represent you in this transaction.  You may waive the right to be represented by a lawyer in this transaction.  You may direct any complaints concerning violations of your rights listed in this Part III to the Massachusetts Department of Banks.
